This booking photo provided by the Los Angeles County Sheriff's Department on Friday shows suspect Sergio Alvarez, 30, who is accused of strangling a pelican to death.

MALIBU, Calif. (AP) — Prosecutors have charged a homeless man with felony animal cruelty after he allegedly grabbed a pelican in Malibu and strangled the bird with his bare hands.

Los Angeles County district attorney's spokeswoman Jane Robison says 30-year-old Sergio Alvarez who was charged Friday.

Alvarez was arrested after witnesses told investigators that he had the pelican by its throat and was choking it with both hands near the Malibu pier on Wednesday night.

The bird's wings were flapping in distress before it went limp and died.

Los Angeles sheriff's officials say Alvarez was allegedly going to eat the pelican because he hadn't been able to catch any fish.

The dead bird was taken by representatives of the California Wildlife Center.
