The Los Angeles District Attorney's office found insufficient evidence to charge Jose Reyes, a truck driver involved in the Tunnel fire, with misdemeanor vehicular manslaughter, according to a DA statement.

He was the driver of the first truck to crash in the truck tunnel on Interstate 5 in the Newhall Pass Oct. 12, 2007, which started a chain reaction resulting in a fire. The traffic collisions and fire killed two men and a boy, and injured 31 people. Reyes was allegedly traveling at least 65 mph through a curve in wet weather, a full 10 mph over the posted limit.

But expert testimony could dispute whether Reyes was going too fast considering the rainy conditions, according to the DA statement.
