Roger Gitlin: The American people will prevail in Arizona

The Arizona judge with no guts removed the guts from the recently passed Arizona immigration law Senate Bill 1070 last week.

Susan Ritchie Bolton, liberal judge of the United States District Court for Arizona, took off her robes and displayed her blatant activist posture by removing some of the most potent parts of SB1070.

Activist Judge Bolton’s ruling prevents Arizona’s law enforcement from verifying immigration status.

Justification: Forestalls Federal law, which creates additional burden on Immigration and Customs Enforcement.

The argument for SB 1070: Arizona supports Federal Law 1324, which the Obama regime fails to perform its constitutionally-mandated duties under Section 4 Article 4 of the Constitution.

Her ruling denies Arizona law enforcement from requiring illegal immigrants to carry papers.

Justification: Arizona may not act in the capacity to create its own state immigration policy.

The argument for SB 1070: Bolton erred in ignoring Section 8 of U.S. Code 1304, which requires all aliens to carry identification. The law is as clear as can be. Every alien in the United States must be fingerprinted and be in possession of an alien registration card. Failure to have that card is grounds for deportation. All law enforcement may ask any alien to produce this document.

The ruling negates Arizona’s contention that it is illegal for illegal immigrants to solicit employment.

The justification: Pre-empts federal law, which (in theory, but not in practice) regulates employment of all aliens.

The argument for SB 1070: Arizona suffers from double-digit unemployment, exacerbated by a federal government that allows illegal immigrants to flow into our country, depress wages and prevent Americans from gaining employment, even modest entry work currently being usurped by illegal immigrants.

Arizona is particularly affected because of its long, porous border with Mexico.

The ruling prevents law enforcement from making warrantless arrests for the purpose of removing illegal immigrants.

The justification: Gives too much leeway and discretion to law enforcement, and Judge Bolton feels there is a substantial likelihood for abuse.

According to Bolton: “There is a substantial likelihood that officers will wrongly arrest legal resident aliens under the new law.”

The argument for SB 1070: Bolton needs to stick with the facts, not her conjecture. Her personal comments of “substantial likelihood” that officers will wrongly arrest smacks of President Barack Obama promulgating his personal bias when he accused the Cambridge, Mass. Police Department of “acting stupidly” in the July 2009 arrest of Harvard professor Henry Louis Gates.

Bolton revealed her liberal and mistrusting partiality against the police.

Again, this activist posing as a judge has removed her judicial garb and is acting in the role of an advocate for those who break America’s first law — entering the U.S. illegally.

All the news is not bad, though. The law, which took effect last Friday, allows for the following:

No sanctuary cities.

It requires law enforcement cooperation with the federal government, permits civil suits by legal residents to sue any state official or agency for adopting a policy which restricts federal immigration law and allows full and aggressive law enforcement on those who engage in human smuggling.

It remains a crime to pick up day laborers.

It remains a crime for businesses to knowingly hire illegal immigrants.

Employers may utilize e-Verify or Social Security number checks and balances to determine an applicant’s ability to work.

It allows funding for gang/immigrant enforcement.

How can illegal immigrants be allowed to solicit work on one hand, and on the other hand employers denied from picking up day laborers and knowingly hiring illegal immigrants? Judge Bolton was schizophrenic in her ruling.

Clinton appointee Bolton tried to appease both sides and in the process satisfied neither. The country is overwhelmingly in support of SB 1070 by a margin that approaches two-thirds of all voters.

Allow me to share with you the most recent FBI statistics on crimes committed by illegal immigrants.
* 83 percent of all murder warrants in Maricopa County are for illegal immigrants.

* 75 percent of those on the most-wanted list in Los Angeles, Phoenix and Albuquerque are illegal immigrants.

* 24 percent of all inmates in California (and Los Angeles County) are Mexican nationals.

* 63 percent of all stopped/cited drivers in Arizona have no license, no insurance and no registration. Of those, 92 percent are illegal immigrants.

* 97 percent of all costs incurred by the 380,000 anchor baby births each year are paid by the American taxpayer. That’s you and me.

I continue to be in great admiration of Arizona Gov. Jan Brewer.

Brewer’s next step is to file an appeal with the notoriously liberal 9th District Court of Appeals in San Francisco.

My guess is this issue will meander its way up the Supreme Court within the next year.

Rule of law will prevail.

Meanwhile, Obama and his sycophants will delay this issue well past the November election.

Ultimately, the American people will prevail — always have and always will.
