Horton, celebrate victory while you can

Regarding Gary Horton’s column (“‘We’ Dems overcome ‘me’ Reps,” March 24) celebrating the Democrats’ passage of the “health care” law: Yes, 34 million more “uninsured” are added to the rolls and it’ll be interesting to watch that burn down America’s financial house.

Not only will it take a money tree somewhere to make this work, it’ll take a whole forest.

By the way, if this is so urgent, why doesn’t all this happen before 2014?

Your celebration is a tad premature, Horton, because not only has the fat lady not sung, she’s still warming up her pipes.

Now this mess enters the legal arena with a slew of constitutional challenges, and I don’t see how it survives. The “mandate” that people buy insurance has always been its Achilles Heel and 13 state attorneys general have already filed lawsuits.

Several states have prepared legislation exempting their citizens from having to participate.

The feds have no authority to “mandate” anybody buy anything. People who try to analogize this with car insurance are all wet, because first of all, that’s a state power — and states can do lots of things the feds can’t — and non-drivers don’t have to buy it anyway. It’s not “universal,” it’s a condition of operating a car on public roads, that’s all.

But this is a “mandate” for just being alive. No can do.

It’s also a bill of attainder, specifically banned by that silly old Constitution.

Further, enforcement would depend on self-reporting, a violation of the 4th and 5th Amendments.

There’s no parallel to taxes, either — I’ve heard the Dems try to make that comparison — as those who don’t work don’t pay taxes.

Not withholding, nor Medicare nor Social Security. But this law “mandates” everyone buy insurance.

Revel in your “victory” while you can, but you’re in for a big disappointment.
