A preliminary hearing has been ordered for an Acton man charged with the shooting death of a fellow Acton man in May, a Los Angeles County District Attorney’s spokeswoman said.

Scott Russell Shipley, 56, appeared Monday in Antelope Valley Superior Court on a single charge of murder in the shooting of 39-year-old Christopher Lawrence Demyen.

Shipley, who has pleaded not guilty, was scheduled to appear for a preliminary hearing Aug. 20, District Attorney spokeswoman Shiara Dávila-Morales said. During that hearing, prosecutors will present evidence in the case, and the defense can respond, after which the judge will decide if the case should go to trial.

Prosecutors say Shipley shot and killed Demyen in Acton on May 15.

Demyen was shot in the torso and pronounced dead that afternoon after the two men got into a verbal argument that turned into a physical altercation, according to a sheriff’s sergeant.

Shipley remains in custody at the Twin Towers Correctional Facility in Los Angeles with bail set at $2 million.
